Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Consumer: the natural person who does not act for purposes related to his/her trade, business, craft, or profession.
  • Entrepreneur: the natural or legal person who offers products, (access to) digital content and/or services at a distance to consumers.
  • Day: calendar day.
  • Right of withdrawal / Return policy: the consumer’s right to cancel a distance contract within the statutory 14-day reflection period.
  • Distance contract: a contract concluded for products, digital content, and/or services using one or more means of distance communication, without the simultaneous physical presence of the consumer and the entrepreneur.
  • Model withdrawal form: the European model withdrawal form included in Annex I of these terms and conditions.

Article 3 – Applicability

These terms and conditions apply to every offer from the entrepreneur and to every distance contract between the entrepreneur and the consumer. Deviations are only valid if agreed upon in writing.

Article 4 – The Offer

  • The entrepreneur offers various Bach flower remedies:
    1. Ready-made mixes (e.g., “Slimming Mix”, “Quit Smoking Mix”).
    2. Personalized mixes prepared to the consumer’s specifications.
  • The offer is clearly described, including price, contents, and instructions for use.
  • Bach flower mixes are dietary supplements; they do not replace medical treatment.

Article 5 – Formation of the contract

  • The contract is concluded once the consumer accepts the offer and confirms the order via the online ordering process or by e-mail.
  • The entrepreneur will send an order confirmation by e-mail.

Article 6 – Right of withdrawal

  • The consumer can cancel a contract for a product within 14 days without giving reasons.
  • The withdrawal period starts the day after the consumer, or a third party designated by the consumer, receives the product.
  • Exceptions: customized products and sealed products where the seal was broken after delivery.

Article 7 – Exercising the right of withdrawal

  • The consumer exercises the right of withdrawal by using the model withdrawal form or another unequivocal declaration.
  • Products should be returned in the original packaging and according to the instructions, unless physically impossible.
  • The consumer bears the direct costs of returning the product.

Article 8 – Refund

  • The entrepreneur will refund the paid amount, including standard shipping costs, within 14 days of receiving the returned product.

Article 9 – Price

  • All prices include VAT and other applicable taxes.

Article 10 – Delivery

  • Orders are shipped as soon as possible, no later than 7 days after confirmation.
  • Delivery takes place at the address provided by the consumer.
  • In case of absence, the order may be delivered to a collection point within 10 km. The consumer must collect the order within 7 days.
  • Delivery issues must be reported within 14 days.

Article 11 – Payment

  • Payment is made immediately for online orders.
  • For orders not paid online immediately, payment is due within 7 days.
  • After this period, a first administrative fee of €5 may be charged.
  • After a third reminder, a formal notice will be sent with an additional collection fee of €50, increasing by €5 monthly until full payment is received.
  • In case of non-payment within the prescribed period, the entrepreneur reserves the right to apply 12% interest and a lump-sum compensation of 10% with a minimum of €100.

Article 12 – Complaints

  • Complaints about products must be reported within 14 days of receipt.
  • Complaints are only handled after payment of the product. Unpaid products are not eligible for complaints.

Article 13 – Limitation of liability

  • The entrepreneur is not liable for indirect or consequential damage.
  • Products are dietary supplements; the entrepreneur provides no medical guarantees.

Article 14 – Disputes

  • Belgian law exclusively applies to contracts between the entrepreneur and the consumer.
  • Disputes will preferably be resolved through mediation. If necessary, the competent court is the court of the entrepreneur’s judicial district.
